Can I legally charge boarding?

Question

Can I legally charge boarding for a dog I've cared for and boarded in my home for 7 months while the owner was in jail?

Answer

Rights to charge for boarding of an animal may depend on the boarding agreement between the parties. For example, was the offer to board the animal at no charge for care and necessities, such as food and veterinary expenses until the person was released from prison, or were no specific terms discussed. There is also a legal theory in the law known as quantum meruit which basically means reasonable value of services rendered. A court may order compensation to be paid for services provided even if there was no specific contract. I hope that you and the dog’s “parent” can work out an equitable agreement that is in the best interests of the dog.
